Buying Property in Greece

People coming from both European and non European countries have got the right to buy property in Greece. In that case there is an exception for those buyers who live in border zone areas. They need a special permit from Greek authorities.

   Cooperation with Greek lawyers can facilitate the process of buying property in Greece.

    The prospective property can be found either through a real estate agent or by personal search. As far as the agent’s fees are concerned they are between 2-4% plus VAT, according  to the market price.

    The buyers’ lawyer should check the titles of the property through a search with the land – registry. Then, a small advance between to 2-5 % of the purchase price is given to the seller after a private agreement.

     The buyer should have a Greek tax ID number, and a bank account in a Greek bank so that the seller can receive the money on the specific date of the contract through bank transfer or bank check.

     The buyer in cooperation with a notary should organize a file with his passport and the Greek Tax ID. On the other hand, the seller also has to collect and file the following documents for the trancaction:

  • a copy of the seller’s deed and a land-registry certificate
  • a certificate from an engineer that the property has been checked and no building discrepancies have been observed or any such have benn legalized
  • a tax clearance certificate
  • an energy efficiency certificate of the property
  • certificate from the tax office that property taxes of the last 5 years before the trancaction have been paid and the property has been properly declared in the real – estate tax declaration of the seller.

The buyer receives full title of the property after all the above mentioned documents have been file and signed by the two parties.

Since the value of the real – estate is more than 250.000 Euro, the buyers from non – European countries have the right to receive a residence permit for themselves and the members of their family, according to the immigration and social intergration Code (4251/14).

   The residence permit is valid for 5 years granted by the Secretary of the Decentralized Administration, under the condition that the applicant personal and fully owns the property in Greece of a values of 250.000 Euro, with the exception of the fact that the two owners are spouses and have got indivisible shares in the property.

   After receiving the residence permit, non Eu – nationals have the right to lease their property. The following members of the family of the applicant, also have the right to receive such permit.
